Introduction to Terms & Conditions
These Terms & Conditions govern all remote mixing and mastering services provided by Dan Leaning ("the Provider"). By engaging the Provider's services, the Client agrees to be bound by these Terms & Conditions.
1. Services
The Provider offers remote audio services including:
Stereo Mixing
Stereo Mastering
Audio Enhancement and Processing
Delivery Preparation for Digital, CD and Vinyl Formats
All services are provided remotely unless otherwise agreed in writing.
2. Project Submission
Clients are responsible for submitting audio files in a professional and organised format.
Submitted files must:
Be production-ready and approved for mixing or mastering.
Be clearly labelled and organised.
Include any desired tuning, editing or creative processing already applied.
Be supplied in an approved WAV or AIFF format.
Compressed formats such as MP3 files will not be accepted.
The Provider assumes submitted files accurately reflect the Client's intended creative direction.
3. Deposits & Payments
A non-refundable deposit of 50% is required before work commences. The remaining balance must be paid in full before final high-resolution files are delivered. Payments may be made via: Bank Transfer, PayPal, or other agreed electronic payment methods. All prices are quoted in GBP (£). Late payments may incur additional charges.
4. Revisions
Mixing projects include up to five (5) rounds of revisions. Mastering projects include up to three (3) rounds of revisions. Revision requests must be submitted within seven (7) days of delivery. Any revisions requested beyond the included allowance or outside the revision period may be charged at the Provider's current hourly rate. Alternate versions, including instrumental, radio edit, censored, vocal up/down or similar derivatives, are not included unless agreed in advance.
5. Turnaround Times
Estimated turnaround times are provided as a guide only and are not guaranteed. Typical turnaround for mixing projects is approximately ten (10) working days from receipt of all required materials and confirmation of booking. Delivery schedules may be affected by:
Project complexity
Studio workload
Client response times
Technical issues beyond the Provider's control
The Client will be notified if significant delays are anticipated.
6. Approval & Project Completion
A project shall be considered approved when:
Written approval is received from the Client; or no revision request or feedback is received within seven (7) days of delivery.
Any work requested after project approval shall be treated as a new booking and charged accordingly.
7. Audio Quality
The quality of the final product is dependent upon the quality of the materials supplied. The Provider reserves the right to refuse, postpone or cancel a project where submitted files are deemed unsuitable for professional mixing or mastering. Examples include:
Excessive clipping or distortion
Missing audio files
Incorrectly labelled stems
Severe phase issues
Poor recording quality
Deposits remain non-refundable where work cannot proceed due to issues with supplied materials.
8. Cancellations & Refunds
Bookings are confirmed upon receipt of deposit payment. If a confirmed booking is cancelled by the Client, a cancellation charge of up to 50% of the agreed project value may apply. Refunds are only available in cases of demonstrable technical failure directly attributable to the Provider. No refunds will be issued based on subjective creative preference once revision allowances have been exhausted.
9. File Delivery & Storage
Final files will be delivered electronically using a file-sharing service selected by the Provider. Projects will be archived for up to one (1) year following completion. While reasonable efforts are made to maintain backups, Clients are solely responsible for creating and maintaining their own copies of all delivered materials .After the archive period expires, files may be permanently deleted without notice.
10. Intellectual Property
The Client retains full ownership of all original recordings, compositions and materials supplied. The Provider retains no ownership interest in the Client's music. Unless otherwise agreed in writing, the Provider may reference completed projects for portfolio, website, social media or promotional purposes. The Client warrants that they possess all necessary rights and permissions relating to materials submitted for processing.
11. Confidentiality
All project materials, communications and information supplied by the Client shall be treated as confidential. The Provider will not disclose, distribute or share Client materials with third parties without prior consent, except where required by law.
12. Third-Party Software
The Provider may utilise third-party plugins, software and processing tools during the provision of services. Due to differences in software versions, operating systems and digital audio workstations, exact reproduction of sounds within the Client's own system cannot be guaranteed. No artificial intelligence processing is used in the creation of mixes or masters unless specifically requested and agreed in writing.
13. Limitation of Liability
The Provider shall not be liable for:
Indirect or consequential loss
Loss of profit or revenue
Commercial losses
Dissatisfaction beyond the agreed revision allowance
The Provider's total liability shall not exceed the amount paid by the Client for the relevant services.
14. Force Majeure
The Provider shall not be held liable for any delay or failure to perform obligations arising from events beyond reasonable control, including but not limited to:
Illness
Equipment failure
Internet outages
Power interruptions
Natural disasters
Government restrictions
15. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
